Privacy Policy – Remindset

Acknowledgements

1. This Privacy Policy should be read in conjunction with the Terms and
Conditions of Remindset. Words and phrases as defined in that document
retain their definition in this Privacy Policy.

2. This Privacy Policy applies to all individuals, or other entities,
that use or access Remindset, including the Remindset Application. This
includes, but is in no way limited to, subscribers to Remindset.

3. This group of people, namely each and every individual and entity to
which this policy relates to, shall hereinafter be referred as “you”
or “your”.

4. We acknowledge the importance of protecting your privacy and rights
in respect of your Personal Information.

5. Your rights to privacy as well as the requirements relating to
collection, management and disclosure of your Personal Information are
set out under the Privacy Act 1988 (Cth) (hereinafter referred to as
the Act). This Privacy Policy is governed under the Act, and is bound
by all provisions therein. To the extent of any inconsistency to the
Act, or any other law, this Privacy Policy is void with the extent of
that inconsistency, and the Act (or other law) shall prevail.

6. The Act sets out a definition of “Personal Information”. This
definition of the phrase is to be used hereinafter in this Privacy
Policy. This definition generally includes any information that can be
used to identify you personally, such information may include your
name, occupation, address, telephone number or email address. The Act contains a complete definition of this phrase.

7. We may make changes to this Privacy Policy from time to time for any
reason. Any changes will made available in an updated Privacy Policy in
the same location where our Privacy Policy is typically found, and
notifications of such changes will be placed on our products and
services for a reasonable time following the changes. This policy was
last updated on 01 Dec 2021.

8. By continuing to use or access Remindset, you agree that you have
read and agree to this Privacy Policy, and acknowledge that you have
been notified of the matters herein.

Information we may collect

9. We may collect any Personal Information, or other information
outside the ambit of the defined Personal Information, that is
reasonably required to provide and run our products and services. This
may include:

a. your name, telephone, residential, mailing and email addresses;

b. your date of birth, gender, or age;

c. any Internet Protocol (IP) addresses, Unique Device Identifiers
(UDIDs) and other unique identifiers in specific circumstances;

d. your contact lists, which reveal details about the contacts
themselves and also a user’s social connections;

e. your location information,

f. your voice, fingerprint or facial recognition biometrics;

g. your hobbies, interests, life goals, and other like information;

h. details of any content made by you using Remindset, including the
technical specifications of the program and/device that was used to
create such content;

i. details of products and services you have either enquired about or
purchased from Remindset; or

j. any other information relating to you and provided by you either
directly or indirectly to us.

10. We may also collect anonymous information on usage of our products
and services. This data is used to evaluate products and services that
we offer, and to improve the content that we produce.

11. Information from third parties such as credit reporting agencies,
banks, law enforcement agencies, and other government agencies may also
be collected.

12. We may also utilise cookies (an online tracking technology) to
recognise your browser or device each time it interacts with us. This
information is used for optimisation of our products and services and
to improve your experience whilst using or accessing Remindset.

13. Websites/applications generally transfer information from cookies
to a device’s hard disk for the purpose of record keeping. Browsers and
devices are usually set to accept standard tracking technologies like
cookies. These tracking technologies do not personally identify you,
but do identify your browser or device. If you would prefer not to
receive cookies, your browser or device can be adjusted to refuse them.
We do not change any cookies settings that have previously been set in
your device or browser.

14. The Collected Information is collected directly from you unless it
is unreasonable or impracticable to do so. If you indirectly provide
Collected Information to us, whether purposely or otherwise, this
information may be collected and stored with the rest of your Collected
Information.

15. We may collect information in ways including (but not limited to)
through:

a. your accessing and use of Remindset;

b. your provision of information to become a subscriber;

c. conversations between you and Remindset or our representatives;

d. your purchases from Remindset;

e. your enquiries for further information on Remindset products or
services;

f. your participation in surveys and other research conducted by
Remindset;

g. you entering of promotions, sweepstakes, lotteries, or contests
hosted by Remindset;

h. you creating any content using Remindset;

i. you saving any content using Remindset;

j. you subscribing to any mailing list, or any other group created by
Remindset; or

k. any other means which results in you directly or indirectly
providing information to us.

16. If you do not provide us with the Collected Information described
above, the following instances may happen:

a. you may not be able to access part, or all, of certain products or
services provided by us;

b. you may not be able to receive specific information about our
products and services; or

c. you may be unable to fully experience or access Remindset products
and services that rely on the provision of such information.

17. If you became aware that we have collected or have access to any
Collected Information to which you do not wish us to have access,
please let us know immediately and we will, if reasonably possible,
remove the Collected Information from our records.

18. Upon being notified of any incorrect or inaccurate information, we
will endeavour to correct our records and minimise any damage or
misinformation resulting from the error. Please note that this may not
be possible if the said Collected Information is essential to the
operation of Remindset.

19. Notwithstanding the above, we are in no way liable for any
incorrect or inaccurate information provided to or collected by us, and
will not be held liable for any harm or damage in any way whatsoever
associated with this incorrect or inaccurate information.

Use and Dissemination of your Collected Information

20. Any Collected Information stored by us is stored in a secure online
and/or physical location and we take all reasonable precautions to
ensure this location is not compromised.

21. We may disclose or disseminate your Collected Information where we
are legally or ethically obligated to, where it is commercially viable
to, or otherwise where we believe it is of benefit to us to disclose or
disseminate such information.

22. Whilst in no way limiting the generality of the foregoing, entities
and persons to whom we may disclose or disseminate your Collected
information include:

a. related Body Corporate’s;

b. our employees, contractors or service providers;

c. IT services including systems administrators, web hosting providers,
mailing houses, payment processors, data entry service providers and
electronic network administrators;

d. professional advisors (eg lawyers, accountants and business
advisors);

e. third-parties and suppliers that we have commercial relationships
with;

f. government and official entities and departments; and

g. any other person or entity that may reasonably benefit from or
require the use of your Collected information.

23. Whilst in no way limiting the above, we may disclose or disseminate
your Collected Information to the aforementioned persons/entities for
purposes including:

a. to comply with relevant laws;

b. to create and run our products and services;

c. business, marketing and other related purposes;

d. legal or business disputes or negotiations;

e. with your express consent; and

f. any other reasonable or required purpose.

24. From time to time direct marketing communications and information
about our products and services that you may have an interest in, may
be sent to you.

25. These marketing communications may be sent via mail, SMS, social
media, fax and/or email and in accordance with applicable laws and your
preferences. We will endeavour to utilise your preferred communication
method where you have indicated it, whenever it is practical to do so.

26. Links to any third-party websites or applications on our products
or services are provided as a convenience to you and are in no way
related to us. Using these links may result in you leaving our website,
application, or other service/product.

27. We take no responsibility for any third party websites or
applications, nor their content or usage of your Collected Information

28. Whilst we take utmost care to ensure the entities that we may
disclose or disseminate your Collected Information are safe and
reliable, we offer no guarantee as to the safety and reliability of any
other entity, and will not be held liable for any use of your Collected
Information by any entities other than Remindset.

29. Where reasonably practical or required, we may ask you for your
express written consent for us to disclose or disseminate your
Collected Information.

30. Whilst we strive to obtain consent at all times, this may not
always be possible, and by using Remindset you agree to this Privacy
Policy and accept that we are not required to obtain your consent to
disclose or disseminate your Collected Information.

31. Notwithstanding the above, there are some circumstances where we
are required by the Act, or other legislation, to expressly obtain your
consent before disclosing or disseminating your Collected Information.
In these circumstances, we will always obtain your express written
consent before disclosing or disseminating your Collected Information.

Breach of Privacy

32. We take any alleged or potential privacy breaches very seriously.
Please notify our Privacy Officer (below) as soon as possible if you do
not believe your Collected Information is completely secure.

33. In the event that you believe your privacy has been breached,
please contact our Privacy Officer providing details of the incident so
that it can be investigated.

34. Such an investigation will involve all practical steps for
determination, assessment, resolution and prevention of any alleged or
actual privacy breach.

35. Following such an investigation, if any adverse findings are made,
we will conduct appropriate remedial processes as required by the Act
or otherwise assessed by us.

and you will be contacted by a representative within a reasonable time
after receipt of your request, queries or complaint to discuss your
concerns and options for resolution.

38. We will endeavour to resolve any complaint in a timely and
appropriate fashion.
